These terms cover how you shop with All-Miami, whether you're buying digital artwork or physical products, and wherever in the world you're shopping from. We've kept them as plain as possible, and the summary below gives you the key points at a glance.

Shipping & downloads
Digital files arrive right after checkout. Physical orders ship to the address you give us.
Personal use
Our artwork and designs are for personal use. You may not copy, resell or redistribute them.
Fair returns
Unused physical items can be returned within 14 days. Digital downloads are final sale, but we'll fix any faulty file.
Local prices
Prices show in your local currency where available. These terms are governed by the laws of Canada.

These Terms of Service ("Terms") apply to your use of the All-Miami website and to every purchase you make from us. When we say "All-Miami", "we", "us" or "our", we mean the operator of this store. When we say "you", we mean anyone who visits the site or buys from it.
By using the site or placing an order, you agree to these Terms and to any policies they refer to, including our Privacy Policy and Refund Policy. If you don't agree, please don't use the site.

You must be at least the age of majority in your province, territory, state or country of residence to place an order. If you're younger, you can only buy with the involvement of a parent or legal guardian who accepts these Terms on your behalf.
You agree to give us accurate, current and complete information at checkout, and to keep it up to date.

All-Miami sells two kinds of products:
Both are often released as collectible drops and volumes. We try to show every product as accurately as possible, but colors, brightness and contrast vary from screen to screen. Physical items may also differ slightly in color, print placement or finish from our photos. Sizes, materials, resolutions and formats are listed on each product page. Please check them before you order.

When you buy a digital product, you don't buy the artwork itself. You buy a personal, non-exclusive, non-transferable license to use the files. This license lets you:
The license doesn't let you sell, sublicense, share, upload, print for sale, or redistribute the files in any form. It also doesn't let you use the artwork in a commercial project, a product, an NFT or an AI training dataset. If you'd like to use our artwork commercially, contact us about a separate license.
When you buy a physical product, you own that item and can use, gift or resell it. Buying it doesn't give you any right to reproduce, copy or commercially use the design printed on it.

We sell to customers in many countries and regions. Depending on where you shop from, prices are shown and charged in your local currency (for example EUR, GBP, CAD or AUD) or in U.S. dollars (USD). The currency you'll pay in is always shown at checkout. Prices can differ from market to market, and your bank or card issuer may charge its own currency conversion or foreign transaction fees.
Applicable taxes, such as VAT or GST, and any shipping costs are calculated at checkout. We can change prices, drops and promotions at any time, but a change never affects an order we've already confirmed.
Payments are processed securely by our checkout and payment providers. We never see or store your full card details. By placing an order, you confirm that you're authorized to use the payment method you provide.
We may refuse or cancel any order, for example because of a pricing error, suspected fraud, or a limit on the number of editions per customer, or an item that turns out to be out of stock. If we cancel an order you've already paid for, we'll refund you in full.

Physical products. We ship orders to the address you give at checkout. Shipping options, costs and estimated delivery times are shown at checkout. Delivery times are estimates, not guarantees, and carrier delays are outside our control. You're responsible for giving us a correct, complete shipping address. Once a carrier confirms delivery to that address, the risk of loss passes to you.
International orders. We ship to the countries and regions offered at checkout. Depending on your destination, your order may be subject to customs duties, import taxes or brokerage fees. Where these are calculated and collected at checkout, they're included in your order total. Otherwise, the recipient pays them on delivery. If you refuse to pay these charges, we can't refund them or the shipping costs.
If your package arrives damaged or never arrives, contact us with your order number and photos (if damaged) as soon as possible, and we'll work with you and the carrier to sort it out.
Digital products. Download links are sent to the email address you give at checkout and are usually available straight away. You're responsible for entering a correct email address and for downloading and saving your files.
Download links may expire or be limited to a set number of downloads. If you lose access or a link stops working, contact us with your order number and we'll do our best to help.

Some releases are sold as limited editions with a fixed number of copies, or as mystery pieces where the artwork is revealed after purchase. These are first come, first served. Placing an item in your cart doesn't reserve it.
Because mystery pieces are revealed after purchase, you can't choose or exchange the design you receive, unless the item is faulty or, for physical items, you need a different size. Edition numbers and edition counts are for collectibility only. They don't create any ownership right, investment value or resale right.

Physical products. You can return eligible items within 14 days of delivery for a refund or exchange. To be eligible, items must be unused, unwashed and in their original condition and packaging, with any tags still attached. Items marked final sale can't be returned. Unless an item arrived faulty, damaged or wrong, you pay the return shipping. Once we've received and inspected your return, we'll refund the original payment method in the currency you paid in. Original shipping costs aren't refundable.
Customers in the EU and UK. You may have a legal right to cancel a purchase of physical goods within 14 days of delivery without giving a reason. To use it, contact us within that period. When you buy a digital product, you ask us to make the files available right away. You agree that you lose your right of withdrawal once the download is made available to you.
Digital products. Digital files can't be returned once they've been delivered, so digital sales are final. We'll still make things right if:
Contact us within 14 days of purchase and we'll replace the file or refund you. For full details, see our Refund Policy. Nothing in these Terms limits any rights you have under the consumer protection laws that apply to you.

All artwork, designs, logos, text, graphics and other content on this site belong to All-Miami or its artists and licensors. This includes the designs printed on our physical products. They are protected by copyright and trademark laws. Apart from the personal license described above, these Terms don't give you any right to use our content.

If you breach these Terms, we may cancel your orders, revoke your license and stop you from using the site.

Our store runs on Shopify and uses third-party payment, shipping and delivery providers. We may also link to other websites. Third-party services have their own terms and privacy policies, and we aren't responsible for their content or practices.

The site and our products are provided "as is" and "as available". We don't guarantee that the site will always be uninterrupted, error-free or secure, that every file will display perfectly on every device, or that physical products will match our photos exactly. To the extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.

To the fullest extent permitted by law, All-Miami and its team, artists and partners aren't liable for any indirect, incidental, special or consequential damages that arise from your use of the site or our products. Our total liability for any claim is limited to the amount you paid for the product the claim relates to.

You agree to indemnify and hold All-Miami harmless from any claims, losses or expenses, including reasonable legal fees, that arise from your breach of these Terms or your misuse of our artwork.

These Terms are governed by the laws of Canada and of the province in which All-Miami is based, without regard to conflict-of-law principles. Any dispute will be handled by the courts of that province, unless the consumer laws where you live give you the right to bring a claim locally. If you shop with us from outside Canada, for example from the European Union, the United Kingdom or Australia, you keep the protection of the mandatory consumer laws of your country of residence.

We may update these Terms from time to time. When we do, we'll post the new version on this page and change the "Last updated" date at the top. Continuing to use the site after an update means you accept the revised Terms. The Terms that apply to an order are the ones in effect when you placed it.
